This is the problem of 'the commons',  IE land held by all, open for use by all and abused by a few for profit, but with hidden costs paid for by all.  Until we can put a $ cost on pollution and stick it firmly on those that benefit from it, we all lose (while a few make out like bandits, however legally.)
