Laws vary from country to country.  For the US, Copyright.gov has the following brief summary: " The term of copyright for a particular work depends on several factors, including whether it has been published, and, if so, the date of first publication. As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years. For an anonymous work, a pseudonymous work, or a work made for hire, the copyright endures for a term of 95 years from the year of its first publication or a term of 120 years from the year of its creation, whichever expires first. For works first published prior to 1978, the term will vary depending on several factors. To determine the length of copyright protection for a particular work, consult chapter 3 of the Copyright Act (title 17 of the United States Code). More information on the term of copyright can be found in Circular 15aDuration of Copyright, and Circular 1Copyright Basics."  As has already been noted, for the specific question of BHL, permission can be granted to BHL and has been given in several cases to allow more recent publications to be available there.  If you are able to make good scans and provide them to BHL, that speeds up the process, once permission exists.

Yes, BHL is very good about scanning biological / systematics journals. 

The only complication here is that the "Leaflets of Malacology" are presumably still under copyright protection.  Stillman Berry died in 1984, and I do not know who would have inherited his literary rights (he died single, no children).  BHL may have a hard time finding someone to ask for permission...

In order to do that you need to contact BHL and get in touch with their copyright contact person, agree to terms, and sign a contract with a copyright waiver. We went through that process a few years ago with the Festivus and gave them permission to scan and publish works more than two years old - so that we could stay afloat finanially and still be able to sell current and some older copies of the journal.

How does one go about having BHL scan the leaflets in. For some reason, I have a great number of the leaflets. (I say that as my primary focus is Eastern U.S.)  I would be willing to loan for scan. But how does one go about doing it?
