Mr. McEathron,
I forwarded your email to our policy office for clarification.  Here are
responses I received --

1) Anything that we (AMC, DMA, NIMA and NGA) has provided to USGS to make
available to the public via sale (e.g. VietNam) have been reviewed for
sensitivity and or classification and determined that these products no
longer merit protection.  If the products were once classified, they have
been declassified.  For example, the planning map for the Invasion of Iwo
Jima was once Top Secret but has been declassified and you can see that the
classification has been lined out.

2) Bottom line, if a product is made available to the public via USGS or
it's agents, the product is considered in the public domain, available for
use by anyone for any purpose.

Dear Ms. Ford,

Are there any current restrictions pertaining to the use of the Joint
Operational Graphics (JOG) maps that are available for sale to the public
via the United States Geological Survey and many private vendors such as
East View Cartographic and Omni Resources?  I am assuming that those maps
that are being sold to the public and are generally stamped "declassified"
as well as those that were originally deposited as part of the Army Map
Service depository program are in the public domain. There is still a lot of
confusion about this issue in the library community because of the legacy of
restrictions from the AMS depository program.

I ask because a group of geographers here at the University of Kansas is
working on a project funded by the Geneva International Centre for
Humanitarian Demining (GICHD).  They would like us to scan a large number of
JOGs from our collections and make them available in digital form as part of
the project.
