We used to ILL our maps, but no longer do due to the damage they tend to get in the postal system in each direction.
Instead we now make a colour copy and post that to the receiving library with instructions to destroy it when the patron has finished with it (i.e. he can't keep it, but doesn't need to return it).
This counts as 'reproduction for preservation' in my book.

For use in an article or book, the author would need to clear copyright. In a journal the editor should be onto this, rather than you as the person doing the physical copying.
No permission would be needed if the article was a review, or other direct criticism of the article (similar to the ability to quote extensively form a text for purposes of review/criticism).

Of course, CC or public domain maps, where they exist, are the best, as they avoid any legal issues.

Subject: scanning maps vis-a-vis copyright

Hi all -

I have what I would have thought to be a pretty elementary question but I'm having problems finding answers.
I'm curious about scanning policies for local users, non-affiliated users, and formal ILL requests.
When I scan a map, I have this nagging believe that I've just reproduced 100% of a copyrighted work at 300 dpi.
I think that exceeds fair use and even academic use (maybe); should I only scan 20% of the map?

I also have been asked about providing scans of maps suitable for publishing in articles.
Would the author need an insubstantial part of the larger work, with a citation?
Are they limited to CC or public domain maps?

Thanks for any insight or direction you might offer.
