As promised, please see the attached guidance for updating your institution-wide Clery Act policy to bridge the gaps between the Clery Act/VAWA and Title IX. You will find three sections, with each heading highlighted, in the document. Instructions for each section are provided below.

* Definitions - Please ensure that these definitions, as written, are included in your policy. These are the definitions directly related to VAWA. You may adjust the formatting to fit your institution policy template.

Today I learned of a new requirement for Financial Aid audits that are currently occurring on some of our campuses and will impact all institutions in the coming years. As you know, the Clery Act and VAWA Amendments fall under Title IV (federal financial aid) Program Participation Agreement regulations. For the first time, institutions undergoing Financial Aid audits being conducted by the Georgia Department of Audits and Accounts (DOAA) are being asked to include documentation supporting the Clery crime and fire statistics included in Annual Security Reports and Fire Safety Reports. I trust all are well during this busy, busy finals and commencement season. For those who attended our April training, you may remember hearing UCR or FBI Uniform Crime Reporting Program mentioned as a resource that is specifically important for our Clery Coordinators to have at hand when your teams are making crime classification determinations. Clery Fines Levied Against Liberty University

Good afternoon, Clery Team,

I am writing to share with you news that was released earlier today. The U.S. Department of Education has levied a negotiated fine of $14M, plus $2M to be expended on program improvements, against Liberty University in Lynchburg, VA. Not only is this the largest fine ever levied for non-compliance with the Clery Act, but it is also only about $4M less than the total of all previous fines combined. I am working with the CCGA Clery Compliance Committee to develop a standard emergency procedures poster for dissemination on our main campus and off-campus instructional site.

As we know, the value of an emergency procedures poster on a college or university campus stems from its ability to raise safety awareness, provide immediate guidance during emergencies, reduce panic, ensure regulatory compliance, facilitate communication, and serve as a training tool for the campus community.

I trust all are well and safe this brisk early evening. Just a few reminders for you. Tomorrow, October 18th is the last day to enter Clery crime statistics in the online portal (Westat). If you haven't already done so, please begin that process first thing Wednesday (tomorrow) morning to ensure you have "locked" your submission well before the portal closes tomorrow night. Additionally, if you haven't done so, please upload a copy of your certificate of completion into Teams ASAP.

Title IX Appeal Process Guidance

As you may be aware, the U.S. Department of Education delayed the release of the new Title IX regulations until October. Consequently, the USG Sexual Misconduct Policy will be updated later than initially expected. In the interim, attached is guidance regarding sexual misconduct appeals proceedings as prepared by USG Legal Affairs, Title IX and Clery Act officials . Please ensure that your institutional procedures reflect the attached guidance pursuant to 34 CFR 106.45(b)(8)(iii)<https://www.ecfr.gov/current/title-34/part-106/section-106.45#p-106.45(b)(8)(iii)>. Additionally, this guidance should be reflected in your 2023 Annual Security Report pursuant to 34 CFR 668.46(k)<https://www.ecfr.gov/current/title-34/part-668/subpart-D#p-668.46(k)>.

As promised, please find attached the slides from our training this afternoon. Also attached is the language from the Federal Register and Code of Federal Regulations regarding recordkeeping requirements for Clery-related documents and fire safety-related documents for your reference. To ensure each of our USG institutions has the appropriate recordkeeping requirements in policy, we are asking that you include the language from slide 8 in your Clery Act policy. Additionally, we are asking you to include this information in your ASR for transparency and as another means to document compliance with the recordkeeping requirements.

Campus Safety & Security - Lauren McCluskey’s Murder

Dear Colleagues,

As you may recall, Lauren McCluskey, a student-athlete at the University of Utah, was killed on campus on October 22, 2018.

A 90-minute ESPN documentary titled "Listen" details Lauren's life and tragic death.

The documentary underscores victim rights and prevention education requirements of the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act) as a stark reminder of the reality of dating violence and stalking on campus. Colleges and universities must do more to ensure their responses to intimate partner violence on campus "protect victims' safety and encourage accountability" for abusers, as stated
